Das Nationale Amt f\u00fcr geistiges Eigentum (im folgenden „HIPO“ genannt) h\u00e4lt eine Liste von Start-up-Unternehmen und Unternehmen, die Start-Up-Unternehmen in Ungarn unterst\u00fctzen.<\/p>\n

Die Registrierung durch das HIPO ist eine Voraussetzung f\u00fcr den Steuervorteil nach \u00a7 7 des Gesetzes LXXXI. von 1996 \u00fcber das K\u00f6rperschaftsteuerrecht.<\/p>\n

Gem\u00e4\u00df dem o.e. Gesetz kann die Investition die K\u00f6rperschaftssteuer-Bemessungsgrundlage in einem Start-up-Unternehmen bis zur H\u00f6he von 20 Millionen HUF in einem Steuerjahr, bis zum dreifachen der Kosten des Erwerbs des Gesch\u00e4ftsanteils reduzieren. Der Rabatt kann im Steuerjahr des Erwerbs, bis zu\u00a0drei Steuerjahren danach verwendet werden.<\/p>\n

Bedingungen f\u00fcr den Steuervorteil gem\u00e4\u00df Regierungsverordnung 331\/2017. (XI. 9.):<\/p>\n

    \n
  1. Weder der Anleger noch sein Vorg\u00e4nger oder ein mit ihm verbundenes Unternehmen war innerhalb von drei Steuerjahren vor dem Erwerb Gesellschafter der Start-up- Gesellschaft;<\/li>\n<\/ol>\n

     <\/p>\n

      \n
    1. Der Anleger und das Start-Up-Unternehmen muss eine, vom HIPO ausgestellte Registrierungsnummer haben;<\/li>\n<\/ol>\n

       <\/p>\n

        \n
      1. Das Start-Up-Unternehmen muss innerhalb von drei Kalenderjahren, gerechnet vom Tag der Einreichung des Antrags f\u00fcr die Registrierung beim HIPO gegr\u00fcndet werden;<\/li>\n<\/ol>\n

         <\/p>\n

          \n
        1. Die j\u00e4hrlichen Umsatzerl\u00f6se des Start-Up-Unternehmens sind niedriger als 100 Millionen HUF vor der Einreichung des Registrierungsantrages beim HIPO;<\/li>\n<\/ol>\n

           <\/p>\n

            \n
          1. Die Anzahl der Mitarbeiter des Start-up-Unternehmens betr\u00e4gt im Gesch\u00e4ftsjahr vor der Anmeldung zur Registrierung bei HIPO mindestens zwei und maximal zwanzig Personen;<\/li>\n<\/ol>\n

             <\/p>\n

            1. Manager von Risikokapitalfonds haben nicht ins Start-Up-Unternehmen investiert;<\/li>\n<\/ol>\n

               <\/p>\n

                \n
              1. Das\u00a0Start-Up-Unternehmen hat keinen Anteil an einer anderen Wirtschaftsgesellschaft;<\/li>\n<\/ol>\n

                 <\/p>\n

                  \n
                1. Die T\u00e4tigkeit des Start-Up-Unternehmens erf\u00fcllt die Bedingungen des Gesetzes LXXVI aus dem Jahre 2014 \u00fcber wissenschaftliche Forschung, Entwicklung und Innovation;<\/li>\n<\/ol>\n

                   <\/p>\n

                  1. Das Start-Up-Unternehmen und der Investor haben keine Steuerr\u00fcckst\u00e4nde.<\/li>\n<\/ol>\n
