K\u00fclf\u00f6ldi\u00a0tulajdonosok, \u00fcgyvezet\u0151k\u00a0vagy\u00a0nemzetk\u00f6zi\u00a0szerz\u0151d\u00e9ses\u00a0partnerek\u00a0eset\u00e9n\u00a0k\u00fcl\u00f6n\u00f6sen\u00a0gyakori, hogy\u00a0egy\u00a0c\u00e9galap\u00edt\u00e1s\u00a0vagy\u00a0ad\u00f3\u00fcgyi\u00a0elj\u00e1r\u00e1s\u00a0nem a gazdas\u00e1gi\u00a0k\u00e9rd\u00e9seken, hanem a formai\u00a0hi\u00e1nyoss\u00e1gokon\u00a0cs\u00faszik el.<\/p>\n<p>A magyar\u00a0hat\u00f3s\u00e1gok\u00a0alapvet\u0151en\u00a0<strong>dokumentum<\/strong><strong>&#8211; <\/strong><strong>\u00e9s<\/strong><strong>\u00a0<\/strong><strong>formaorient\u00e1lt<\/strong><strong>\u00a0<\/strong><strong>rendszert<\/strong>\u00a0m\u0171k\u00f6dtetnek. Ez azt\u00a0jelenti, hogy a tartalmi\u00a0helyess\u00e9g\u00a0mellett\u00a0kiemelt\u00a0szerepe van annak, hogy\u00a0az\u00a0adatok\u00a0pontosan, k\u00f6vetkezetesen\u00a0\u00e9s\u00a0megfelel\u0151\u00a0nyelven\u00a0jelenjenek meg a sz\u00fcks\u00e9ges\u00a0iratokban. Egy apr\u00f3\u00a0elt\u00e9r\u00e9s\u00a0p\u00e9ld\u00e1ul\u00a0egy\u00a0m\u00e1sk\u00e9pp\u00a0\u00edrt\u00a0n\u00e9v\u00a0vagy\u00a0egy\u00a0nem\u00a0megfelel\u0151\u00a0ford\u00edt\u00e1s\u00a0k\u00f6nnyen\u00a0vezethet\u00a0elutas\u00edt\u00e1shoz\u00a0vagy\u00a0jelent\u0151s\u00a0k\u00e9sedelemhez.<\/p>\n<p>Ez az\u00a0\u00f6sszefoglal\u00f3\u00a0bemutatja, hogy a magyar\u00a0jogrendben\u00a0<strong>milyen<\/strong><strong>\u00a0<\/strong><strong>szem\u00e9lyes<\/strong><strong>\u00a0<\/strong><strong>adatok<\/strong><strong>\u00a0<\/strong><strong>\u00e9s<\/strong><strong>\u00a0<\/strong><strong>dokumentumok<\/strong><strong>\u00a0<\/strong><strong>sz\u00fcks\u00e9gesek<\/strong>, mit\u00a0fogadnak\u00a0el a hat\u00f3s\u00e1gok, \u00e9s\u00a0mikor\u00a0sz\u00fcks\u00e9ges\u00a0hiteles\u00a0ford\u00edt\u00e1s\u00a0vagy\u00a0tov\u00e1bbi\u00a0hiteles\u00edt\u00e9s.<\/p>\n<p><strong>A <\/strong><strong>magyar<\/strong><strong>\u00a0<\/strong><strong>jogi<\/strong><strong>\u00a0<\/strong><strong>k\u00f6rnyezet<\/strong><strong>\u00a0<\/strong><strong>alaplogik\u00e1ja<\/strong><\/p>\n<p>A magyar\u00a0hat\u00f3s\u00e1gi\u00a0\u00e9s\u00a0c\u00e9gjogi\u00a0elj\u00e1r\u00e1sok\u00a0k\u00e9t\u00a0alapelvre\u00a0\u00e9p\u00fclnek: a formai\u00a0megfelel\u00e9sre\u00a0\u00e9s\u00a0az\u00a0egy\u00e9rtelm\u0171\u00a0azonos\u00edthat\u00f3s\u00e1gra.<\/p>\n<p>A formai\u00a0megfelel\u00e9s\u00a0azt\u00a0jelenti, hogy a dokumentumoknak\u00a0pontosan meg kell\u00a0felelni\u00fck a jogszab\u00e1lyi\u00a0k\u00f6vetelm\u00e9nyeknek. Nem elegend\u0151, hogy\u00a0egy\u00a0irat \u201etartalmilag\u201d helyes\u00a0legyen: a megfelel\u0151\u00a0nyelv, a megfelel\u0151\u00a0hiteles\u00edt\u00e9s, a sz\u00fcks\u00e9ges\u00a0adatok\u00a0\u00e9s a formai\u00a0k\u00f6vetelm\u00e9nyek\u00a0egyar\u00e1nt\u00a0sz\u00e1m\u00edtanak.<\/p>\n<p>Az egy\u00e9rtelm\u0171\u00a0azonos\u00edthat\u00f3s\u00e1g\u00a0elve\u00a0pedig\u00a0azt\u00a0jelenti, hogy a hat\u00f3s\u00e1goknak\u00a0minden\u00a0esetben\u00a0k\u00e9ts\u00e9get\u00a0kiz\u00e1r\u00f3an\u00a0azonos\u00edtaniuk\u00a0kell a szem\u00e9lyt\u00a0vagy a c\u00e9get. Ez azt\u00a0jelenti, hogy\u00a0elvileg\u00a0minden\u00a0hat\u00f3s\u00e1gi\u00a0elj\u00e1r\u00e1sban\u00a0magyar\u00a0nyelv\u0171\u00a0dokumentumokra van sz\u00fcks\u00e9g.<\/p>\n<p>A gyakorlat\u00a0azonban\u00a0enn\u00e9l\u00a0rugalmasabb. Sz\u00e1mos\u00a0esetben\u00a0elfogadj\u00e1k\u00a0az\u00a0angol\u00a0nyelv\u0171\u00a0dokumentumokat, k\u00fcl\u00f6n\u00f6sen\u00a0akkor, ha azok\u00a0tartalma\u00a0egy\u00e9rtelm\u0171. Ilyen\u00a0lehet\u00a0p\u00e9ld\u00e1ul:<\/p>\n<ul>\n<li>\u00fatlev\u00e9l,<\/li>\n<li>angol\u00a0nyelv\u0171\u00a0c\u00e9gkivonat,<\/li>\n<li>banksz\u00e1mlakivonat,<\/li>\n<li>t\u00f6bbnyelv\u0171\u00a0hivatalos\u00a0okirat.<\/li>\n<\/ul>\n<p>Fontos azonban\u00a0meg\u00e9rteni, hogy\u00a0ez\u00a0<strong>nem<\/strong><strong>\u00a0<\/strong><strong>automatikus<\/strong><strong> jog<\/strong>, hanem\u00a0gyakorlati\u00a0k\u00f6nny\u00edt\u00e9s.
